Terms of Service

1. Acceptance

These Terms of Service (“Terms”) form a binding agreement between you (“you,” “your”) and FlowFaze (“FlowFaze,” “we,” “our,” “us”) governing your access to and use of the flowfaze.ai service, including the website, dashboard, APIs, and any related content (collectively, the “Service”). By creating an account, connecting a third-party platform, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

FlowFaze is an AI-assisted content marketing platform. It helps you research, generate, schedule, and publish content (blog posts and social media posts) to third-party platforms you connect. Features, plans, and pricing may change over time; we will give reasonable notice before any material reduction in functionality that affects active paid plans.

3. Accounts

Eligibility

You must be at least 16 years old and legally able to enter into a contract in your jurisdiction. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Account security

You are responsible for keeping your password and authentication factors confidential and for any activity under your account. Notify us at support@flowfaze.ai immediately if you suspect unauthorized access.

Accurate information

You agree to provide accurate, current information when creating an account or connecting third-party platforms, and to keep that information up to date.

4. Your content

Ownership

You retain all rights to the websites, brand assets, prompts, drafts, edits, and other materials you supply to the Service (“Your Content”), and to the AI-generated drafts produced for your account.

License to operate the Service

You grant FlowFaze a worldwide, non-exclusive, royalty-free license to host, copy, transmit, process, and display Your Content solely as needed to operate, improve, and support the Service for you — including sending Your Content to third-party AI providers and publishing to the platforms you connect.

Responsibility for what you publish

You are solely responsible for content you publish through the Service. You represent that you have the rights to publish it and that doing so does not violate any law or third-party rights.

5. AI-generated content

The Service uses third-party AI providers to generate text, image placement plans, and topic suggestions. AI output can be inaccurate, biased, or otherwise unsuitable for your needs. You are responsible for reviewing AI-generated content before publishing it. FlowFaze makes no warranty that any AI-generated content is accurate, original, non-infringing, or fit for any particular purpose.

We do not knowingly use Your Content to train any third-party model, and we configure providers to disable training-on-prompt where the option is available. See our Privacy Policy for details.

6. Stock media (Pexels & Pixabay)

Images and short video clips attached to your content are sourced from third-party stock-media providers (Pexels, Pixabay). Those assets are licensed by their respective providers under their own terms. By accepting an asset into your content, you agree to comply with the licensor's terms (Pexels license, Pixabay license). FlowFaze does not own these assets and provides them “as is.”

7. Connected platforms

The Service publishes to platforms you connect via OAuth — Facebook, Instagram, LinkedIn, X (Twitter), Google Search Console, and WordPress. Each platform has its own terms and policies, which you must follow. FlowFaze acts on your instructions and is not responsible for actions those platforms take independently (rate limits, content moderation, API changes, account suspensions). You can revoke FlowFaze's access at any time from the relevant platform's settings or from Settings → Connections inside FlowFaze.

8. Acceptable use

You agree not to use the Service to:

  • Violate any law, regulation, or third-party right (including intellectual property, privacy, or publicity rights);
  • Generate or publish content that is unlawful, defamatory, harassing, threatening, hateful, sexually explicit involving minors, or that depicts non-consensual intimate imagery;
  • Impersonate another person or misrepresent your affiliation with any person or entity;
  • Send spam, run unsolicited bulk messaging, or post deceptive or manipulative content (including coordinated inauthentic behavior on social platforms);
  • Probe, scan, or test the vulnerability of the Service, bypass rate limits, or attempt to access data not intended for you;
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service, except where this restriction is prohibited by applicable law;
  • Resell, sublicense, or repackage the Service without our written consent.

We may suspend or terminate accounts that violate this section, with or without notice depending on the severity.

9. Plans, payment, and refunds

Plans and pricing

Paid plans are billed in advance on a monthly or annual basis at the price displayed at signup. Prices may change with at least 30 days' advance notice for active subscribers.

Payment processing

Payments are processed by Stripe under Stripe's terms. We never store full card numbers.

Refunds and cancellation

You may cancel anytime from Settings → Billing; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law or expressly stated.

Taxes

Prices exclude applicable taxes (VAT, GST, sales tax). You are responsible for any taxes assessed on your purchases.

10. Free trials and beta features

We may offer free trials or beta features. These are provided “as is” and may be modified or discontinued at any time. We may impose usage limits on free trials and convert them to a paid plan unless cancelled before the trial ends, in which case you authorize the corresponding charge.

11. Termination

You may stop using the Service and delete your account at any time from Settings → Account → Delete Account. We may suspend or terminate your access if you materially breach these Terms, if continued service would cause us to violate law, or for other reasons described in these Terms.

On termination, your right to use the Service ends immediately. We will delete your account data within the timeframes described in our Privacy Policy. Sections of these Terms that by their nature should survive termination (e.g., ownership, disclaimers, limitations of liability, indemnification) will continue to apply.

12. Disclaimers

The Service and all AI-generated output are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted or error-free. To the maximum extent permitted by law, we disclaim all such warranties.

13. Limitation of liability

To the maximum extent permitted by law, FlowFaze and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to the Service, even if advised of the possibility. Our aggregate liability for all claims arising out of or related to the Service in any 12-month period will not exceed the greater of (a) the amounts you paid us for the Service in the 12 months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

14. Indemnification

You agree to defend, indemnify, and hold harmless FlowFaze and its officers, employees, and agents from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of (a) Your Content; (b) content you publish through the Service; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

15. Third-party services

The Service integrates with third-party services (e.g., Meta, LinkedIn, X, Google, Stripe, Pexels, Pixabay). FlowFaze is not responsible for those services, their availability, or their terms. Your use of any third-party service is governed by that service's own terms.

16. Changes to the Service or these Terms

We may update the Service or these Terms from time to time. When we make material changes to these Terms, we will update the “Last updated” date and, where appropriate, notify you by email or in-app banner. Continued use after a change becomes effective constitutes acceptance of the updated Terms. If you do not agree, stop using the Service.

17. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law provisions. The exclusive venue for any dispute is the state and federal courts located in Delaware, and you consent to personal jurisdiction there. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.

18. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and FlowFaze regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
